In no event shall our total aggregate liability for all claims arising out of or relating to the use of, or inability to use, the website or services exceed the amount you have paid to Moravexi, if any, during the twelve (12) months preceding the event giving rise to the liability, or one hundred Euros (€100), whichever is greater.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Irish law. Your statutory rights as a consumer under Irish and EU consumer protection legislation are not affected by these Terms.

These Terms, their subject matter, and their formation (including any non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Republic of Ireland, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of or related to these Terms or the website shall be instituted exclusively in the courts of Ireland, and you irrevocably submit to the exclusive jurisdiction of such courts. Notwithstanding the foregoing, if you are a consumer habitually resident in the European Union, you may also bring proceedings in the courts of the EU member state in which you reside, and nothing in these Terms shall deprive you of any mandatory consumer protection rights under the laws of your country of residence.

If informal resolution is unsuccessful within thirty (30) days of your initial contact, either party may pursue formal legal proceedings as described in Section 10 above. For consumers resident in the European Union, you may also use the European Commission's Online Dispute Resolution platform, accessible at https://ec.europa.eu/consumers/odr, to submit a complaint and seek resolution through an approved Alternative Dispute Resolution body.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts where necessary to protect intellectual property rights or prevent irreparable harm.

12. Termination

We may, at our sole discretion, suspend or terminate your access to the website at any time, with or without notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the website will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability. Termination of your access does not relieve you of any obligations incurred prior to termination, including any outstanding payment obligations for products or services purchased.

13. Changes to Terms

We reserve the right to revise and update these Terms from time to time at our discretion. All changes are effective when posted on this page, with the updated "Last Updated" date at the top of the document. For material changes that significantly affect your rights or obligations, we will provide at least fourteen (14) days' advance notice by posting a prominent notice on our website before the changes take effect.

Your continued use of the website following the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the updated Terms, you must stop using the website. We encourage you to review these Terms periodically to stay informed about your rights and obligations.

14. Alcohol-Specific Terms

By purchasing alcoholic products from Moravexi, you confirm that you are at least 18 years of age, as required under the Intoxicating Liquor Act 1988 (as amended) of Ireland. We reserve the right to request proof of age at any stage, including at the point of delivery. If satisfactory proof of age cannot be provided, we may refuse to complete the sale or delivery.

It is an offence for any person under the age of 18 to purchase, or attempt to purchase, alcohol. It is also an offence for any person to purchase alcohol on behalf of a person under the age of 18. By placing an order, you confirm that neither you nor the intended recipient of any alcoholic products is under 18 years of age.

Alcohol products are available for sale and delivery only within the Republic of Ireland, unless otherwise stated. Delivery of alcohol may be subject to additional terms and conditions.
